Successful Verdict for Davis, Burch & Abrams!

In October 2020, Chris Davis and Destinee Byers successfully obtained a $256,650 jury verdict on a breach of an employment agreement claim in Norfolk. The plaintiff in this matter was allegedly terminated “for cause” by Allied Research Technologies, Inc. in Norfolk for not appearing at work during certain hours. However, under his employment agreement, if the plaintiff had been terminated “without cause” he would have been entitled to a buy-out of his 5% vested equity interest.

Plaintiff filed suit with Davis, Burch & Abrams claiming that he was instead terminated “without cause” because the plaintiff was a manager, and his work hours were discretionary. The hours plaintiff worked were not a “directive” from upper management.  After a four-day jury trial in Norfolk Circuit Court, the jury found Allied Research Technologies, Inc. had breached the employment agreement with the plaintiff by not paying him his 5% vested equity interest. The Court awarded the total amount requested of $256,650. The verdict was published in Virginia Lawyers Weekly in March of 2022.
