No. While much of our work involves complex commercial and corporate disputes, we also handle appeals in criminal, domestic, and other civil matters.

The standard of review is the lens the appellate court uses to evaluate the trial court’s decision. In appellate litigation, it often determines the outcome.

Whether the court reviews an issue de novo (from scratch), for abuse of discretion (with deference), or for clear error (focused on the factual record) shapes which arguments matter and which do not.

An experienced appellate attorney builds the appeal around that framework. Some issues are worth pressing; others are not, depending on how the court is required to review them. The standard also influences how the record is used, how arguments are framed, and what the court needs to see to reverse.

We don’t just argue that the trial court was wrong—we structure the appeal strategy around the standard that gives the court a clear path to rule in our client’s favor.

If an issue isn’t properly raised and preserved in the trial court, you usually can’t raise it on appeal. Appellate courts generally don’t consider new arguments—they review the record that was built below.

That’s why preservation matters. Objections, rulings, proffers, and how issues are framed at trial all determine what can be reviewed later. In appellate litigation, a strong argument on the law won’t matter if the issue wasn’t preserved correctly.
